Trademark Registration

A trademark is a sign, logo, name, or symbol that distinguishes your goods or services from others in the market. Registering a trademark in Nepal ensures your exclusive right to use that brand name and take legal action against infringement.

Legal Basis:

Trademark registration in Nepal is governed by the Patent, Design and Trademark Act, 2022 (1965).

 Who Can Register?

  • Individuals
  • Companies (Nepalese or foreign)
  • Partnership firms
  • NGOs and cooperatives using a trade name

Trademark Registration Process in Nepal:

  1. Search for trademark availability at the Department of Industry (DOI)
  2. File an application with necessary documents
  3. Examination by the DOI
  4. Publication in the IP Bulletin
  5. Opposition window (35 days)
  6. Final registration and certificate issuance

Required Documents:

  1. Copy of business registration
  2. Logo or wordmark sample
  3. Power of Attorney (if applying through a lawyer)
  4. Citizenship or passport of applicant

Validity

Registered trademarks are valid for 7 years and can be renewed indefinitely every 7 years.
